Trustees get court order extending vesting date
In this segment of the notes we discuss two recent cases in which the Queensland Supreme Court was required to consider whether it was empowered under S.94 of the Trusts Act 1973 (Qld) to make an order authorising the trustees to amend the current vesting date of two discretionary trusts from 16 February 2017 to 16 February 2057 (i.e., to extend the vesting date by 40 years).
