- The Customer agrees that the restraints set out in clause 8 above will be construed to the maximum extent and have effect as if they were a number of separate and independent provisions, which result from combining each of the restraints within the Restrained Period, each such resulting obligation being severable from each other resulting obligation.
- If any such separate sub-clause is deemed to be invalid or unenforceable for any reason, such invalidity or unenforceability will not prejudice or in any way affect the validity or enforceability of any other separate provision.
- The Customer and CAN agree that the provisions of this clause 8 are reasonably required to protect the goodwill of CAN and the parties intend the provisions to operate to the maximum extent given the nature of the business of CAN on the basis that its Service Personnel form an integral part of the intellectual property associated with its business and valuable reputation in the market.
